“Anyone Promoting Militancy is a Militant”- Lok Sabha Passes Bill to Amend Unlawful Activities Prevention Act

The Lok Sabha on Wednesday passed the bill that empowers the government to designate individuals as terrorists and empowers the Director-General, National Investigation Agency (NIA) to grant approval of seizure or attachment of property when the case is investigated by the agency.

The Lok Sabha took up the Unlawful Activities (Prevention) Amendment Act Bill for discussion on Wednesday after members of the opposition raised concern over amendments, saying the provisions were against the federal structure of the country.

The amendments proposed to the existing Act say, “Who may commit terrorism”, establishing that under the Act, the Centre may designate an organisation as a terrorist organisation if it commits or participates in acts of terrorism, prepares for terrorism, promotes terrorism, or is otherwise involved in terrorism,” as reported by Live Mint.

The Bill empowers the government to designate individuals as terrorists on the same grounds.

The amendment dis-empowers local Police as NIA will not now need the prior approval of Local Police to sieze properties, the existing act the investigating officer is required to obtain the prior approval of the Director General of Police (DGP) to seize properties.
