Court sentences man to six months imprisonment for modifying Thar

An owner of Thar vehicle has been sentenced to si months Jal in Jammu Kashmir for making illegal modifications to his SUV.

The modifications are directly in violation of Section 52 of Motor Vehicles Act of 1988 (MV Act) [UT of Jammu & Kashmir VS Adil Farooq Bhat].

The list of modifications made to this specific previous-gen Mahindra Thar include a hard top, bigger wheels and tyres, LED lights as well as a high car siren. As per the court order, the structure of the vehicle has been completely modified/altered from its original position as specified in the registration certificate (RC) of the vehicle, Times of India reported.

However, the accused was given the benefit of probation under the Probation of Offenders Act since the offence does not involve any moral turpitude and the fact that the violator has never been convicted prior to this. Instead, the court has directed the Thar owner to execute a bond of Rs 2 lakh for keeping peace and and good behaviour for a period of two years.

Failing to abide by the bond would result in the accused receiving the proposed sentence.

“The RTO Kashmir at Srinagar is directed to remove the car siren and all the modifications those were done in contravention to the provisions of Motor Vehicle Act and the rules made thereunder and restore the vehicle (Thar) to its original position as specified in the Registration Certificate (RC) of the vehicle”, the judgment said.
