Jammu Kashmir government withdraws 2020 orders empowering LG and administrative council

The Jammu Kashmir Government has rescinded several orders that empowered LG as the Chairman of the Administrative Council (AC), with his Advisors, and other officers holding the powers of the Ministers in the Council.

“In pursuance to Notification S.O. 4484(E) dated 13th October, 2024 issued by the Ministry of Home Affairs, Government of India, it is hereby ordered that Government Order No. 808-JK(GAD) of 2020 dated 01.09.2020, Government Order No. 809-JK(GAD) of 2020 dated 01.09.2020, Government Order No. 810-JK(GAD) of 2020 dated 01.09.2020 and Government Order No. 811-JK(GAD) of 2020 dated 01.09.2020, alongwith any modification, alteration or addition are rescinded forthwith,” the Jammu Kashmir government said in an order.

Pertinently, several orders were issued by the central government that formally empowered the LG and his administrative council in Jammu Kashmir to act with the authority of ministers.

After the abrogation of Article 370 and the reorganization of the region into a Union Territory in 2019, the Government of Jammu Kashmir issued specific orders to delegate executive powers to the LG and the Administrative Council.

In particular, orders like those from 2020 (e.g., Government Order Nos. 808-JK(GAD) to 811-JK(GAD) dated September 1, 2020) formalized this arrangement, allowing the LG to chair the Administrative Council and giving his advisors and other designated officers ministerial powers.
