MHA Issues 3rd Order: Anyone In India Can Now Buy Land In Kashmir

The Ministry of Home Affairs, Government of India, announced amendment in land laws to allow everyone in India to buy the land in Jammu and Kashmir which hitherto was exclusively meant for permanent resident of J&K. The ministry of home affairs said that the order will be called the Union Territory of Jammu and Kashmir Reorganisation (Adaptation of Central Laws) Third Order, 2020. A number of amendments have been carried out in the Jammu and Kashmir Development Act to allow the buying of land by anyone as words such as domicile or PRC holders find mention. The “state” has been substituted by “Union territory of Jammu and Kashmir”. Cow slaughter act is being misused against innocent persons: Allahabad HC

On Monday, the Allahabad High Court expressing its concern towards the Uttar Pradesh Prevention of Cow Slaughter Act 1955 said that law was being misused against innocent persons.  The court said, “Whenever any meat is recovered, it is normally shown as cow meat (beef) without getting it examined or analyzed by the Forensic Laboratory. In most of the cases, meat is not sent for analysis. Accused persons continue in jail for an offence that may not have been committed at all and which is triable by Magistrate Ist Class, having maximum sentence up to 7 years."  There has been several incidents when the meat recovered by authorities is presumed to be beef without any analysis or confirmation. The Centre has notified new laws enforced immediately, including fresh land laws, for the Union Territories (UTs) of J&K and Ladakh and omitted any precondition on purchase of land in J&K, as existed under Article 370 for the outsiders. These new laws mean that anyone can now buy land in Kashmir as far as it is not agricultural land. The order has been called the Union Territory of Jammu and Kashmir Reorganisation (Adaptation of Central Laws) Third Order, 2020. Earlier, because of the existence of Article 35A, the purchase of land by citizens of other states of India was prohibited in Jammu and Kashmir.
