HC sets aside single bench judgment, Quashes PSA of Pulwama resident

The Jammu Kashmir High Court has quashed a detention order against a Pulwama resident, who was booked under Public Safety Act (PSA) in 2019.

The division bench comprising Justice Dhiraj Singh Thakur and Justice Sanjay Dhar set aside a single bench judgment and overturned the detention of Riyaz Ahmad Bhat of Pulwama district.

The bench directed the authorities to immediately release the detainee from preventive detention, provided he is not required in connection with any other case.

Earlier, the single bench had upheld the detention order against Bhat, recording that there was no error of law or procedure committed by the official respondents which would invalidate the order of detention.

The detention order passed by district magistrate Pulwama against Bhat on October 16, 2019, mentions the involvement of Bhat in two separate cases bearing FIR 22/20218 registered under Section 307 of the RPC, 7/27 of the Arms Act, and 3/4 of the Explosive Substances Act and FIR 25/2018 registered under Section 307 of the RPC and 7/27 of the Arms Act respectively, both registered at police station Pulwama.
