Central land acquisition act now applicable to Jammu Kashmir

The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013) has been made applicable to Jammu Kashmir.

The Administration of Jammu Kashmir has prepared draft rules in exercise of powers conferred by Section 109 of the said Act which have been published as required under section 112 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of 15 (fifteen) days from the date of publication in Official Gazette. The draft rules are available on the official website of the Revenue Department (https://jkrevenue.nic.in).

“Any objection or suggestion which may be received from any person with respect to the said draft rules within the period so specified shall be considered by the Government,” the officials said.

The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (also Land Acquisition Act, 2013 or LARR Act or RFCTLARR Act is an Act of Indian Parliament that regulates land acquisition and lays down the procedure and rules for granting compensation, rehabilitation and resettlement to the affected persons in India.

The Act has provisions to provide fair compensation to those whose land is taken away, brings transparency to the process of acquisition of land to set up factories or buildings, infrastructural projects and assures rehabilitation of those affected. The Act replaced the Land Acquisition Act, 1894 enacted during British rule.
