Delhi HC issues notice to Yasin Malik in NIA’s plea seeking death penalty

The Delhi High Court has admitted the plea seeking death sentence to JKLF chairman Mohammed Yasin Malik in a militancy funding case and listed the matter for August 09.

Malik, currently serving life imprisonment for the case in New Delhi’s Tihar Jail has been issued notice by the court.

“Since the sole respondent Yasin Malik, inter alia, has pleaded guilty to a charge under Section 121 IPC which provides for an alternate death sentence, we issue notice to him in both the application (for condonation of delay) and the appeal to be served through Jail Superintendent,” the court ordered.

Solicitor General Tushar Mehta, representing the NIA, argued that propagating one region to be separated from the country makes the case “rarest of rare”.

He argued, “Any terrorist can come here and do terrorist activities, and court will say since he has pled guilty, I will give him life (sentence) and not capital,” Mehta said, adding this way everyone will avoid trial.

Mehta also submitted that Yasin Malik is responsible for killing four IAF personnel in Rawalpora, Srinagar and kidnapping of Dr. Rubaiya Sayeed, the daughter of then Union Minister Mufti Mohammed Sayeed.

The Delhi HC has issued the notice on NIA’s plea seeking death penalty for the Kashmiri separatist leader. Yasin Malik will respond to the plea by the NIA that argues it’s a “rarest of rare case”.

The HC has also sought recommendations of the Law Commission on death penalty.
