Additional sessions Court in Islamabad (Anantnag) on Wednesday denied bail to Nageshwar Singh of Himachal Pradesh who has been accused in crime of abducting a girl from Sirigufwara area of South Kashmir’s Islamabad District.
The Parents of the girl had immediately filed an FIR in the Sirigufwara Police station after which the accused was taken into custody and the girl was handed over back to her parents.
The counsel for the accused namely Aijaz Rashid Ganie moved bail petition for seeking his release on the ground that the accused is innocent and has been implicated in false and frivolous case. The counsel for accused further submitted the accused is behind the bars from last 9 months and deserves to be released from the custudy on bail.
The state is represented by Additional Public Prosecutor (APP), Syed Suhail Haqani who happens to be the youngest APP from the district at the age of 32, argued that bail cannot be granted to the accused at this stage as he has abducted a local girl and taken her to another state.
He in his argument said that the accused is involved in a heinous and a non bailable offence which does not deserve any concession at this juncture.
The APP Further submitted not only sec 497c of CRPC has to be considered while considering the bail but the circumstances and statement under section 164A CRPC of the victim has taken into consideration as well. The accused is booked Under FIR No. 28
Year 2017 section 366, 376 and 506 RPC.
After giving thoughtful consideration to the application as well as the case, Additional Sessions Judge (Fast Track), Masarat Shaheen denied the bail application after closely hearing the arguments from both the sides.
Pertinently the accused has been in jail since the 28th of July in 2017.
