The PIL seeking a ban on cow slaughter and enacting strict laws on it was rejected by the High Court.
A division bench of Chief Justice Pankaj Mithal and Justice Rajneah Oswal asked the petitioner to place his demand before the Chief Secretary of Jammu Kashmir.
In the PIL filed in the High Court, the NGO demanded a stringent law against cow slaughter in Jammu Kashmir so that cow slaughter can be stopped in the state. Lawyers appearing on behalf of the petitioner argued in the High Court that cow slaughter was a punishable offense under Ranbir Penal Code RPC.
After coming into force in the state of Jammu Kashmir Reorganization Act-2019, it no longer comes under the category of crime in Jammu Kashmir.
The lawyers also said that the Indian Penal Code is not in the category of cow slaughter in the IPC. If the reason is that there are many states in the country in which Haryana, Uttarakhand and Jharkhand have made laws against their cow slaughter.
After hearing the arguments of the lawyers, the bench also threw light on the decisions of various High Courts in the country prohibiting cow slaughter.
After this, the bench asked the non-governmental organization filing a PIL to file a complaint in this regard with the Chief Secretary of the state. With this, the petition was dismissed.
