Prashant Bhushan Convicted, Sparks Debate On Contempt Of Court

In the contempt case, senior advocate Prashant Bhushan has been convicted by the Supreme Court. Taking suo motu cognizance in the tweet case, the Supreme Court has held lawyer Prashant Bhushan guilty of contempt of court. Now the sentence will be heard on 20 August. During the hearing of this case, Prashant Bhushan had said that the tweet may look unpleasant but not contempt.

According to the provision of the punishment prescribed under Section 12 of the Contempt of Court Act, the convict can be imprisoned for six months or a fine of up to two thousand rupees or both. Now the debate on punishment will be held on 20 August. After this, the Supreme Court will pronounce the sentence.

Contempt of court case against Prashant Bhushan has sparked debate in the society.

While some former judges, former bureaucrats, lawyers and social activists had requested the Supreme Court to “withdraw the contempt cases against Prashant Bhushan in view of the dignity of the Supreme Court.”

So another group wrote a letter to the President of India requesting to save the dignity of the institutions.

131 people whose signature were in the statement issued in favour of Bhushan. Among them is former Chief Justice of the Supreme Court Jasti Chelameswar, Justice Madan B. Lokur, besides former Chief Justice of Delhi High Court (retd) AP Shah, Justice (retired) Anjana Prakash Shamil of Patna High Court.

Apart from these, the signatories are historian Ramchandra Guha, writer Arundhati Roy and lawyer Indira Jaising.

Law experts feel that confrontation occurs when freedom of expression and Article 129 of the Constitution come face to face.

According to the Constitution, every citizen is free to express his views. But when someone comments on the court, they need to keep Article 129 in mind.

There has always been a debate in the judicial circles of India about the contempt of court.
