The Jammu Kashmir High Court has revoked the Public Safety Act (PSA) imposed on the National Conference’s Additional Secretary General and former Minister Ali Mohammad Sagar and directed his immediate release. His son petitioned for the removal and release of PSA.
Ali Mohammad Sagar was taken into preventive custody by the state administration in the circumstances arising out of the imposition of the Jammu Kashmir Reorganization Act on August 5, 2019. On February 5 this year, the administration had arrested him under the PSA.
His case was heard in the court of Justice Sindhu Sharma in the Jammu Kashmir High Court. Justice Sidhu Sharma quashed the order of District Magistrate Srinagar to imprison Ali Mohammad Sagar under PSA.
Ali Mohammad Sagar is the first leader among the various mainstream political leaders who have been incarcerated under PSA during the last one year, whose PSA has been released by the court.
The court, in its judgment, citing N Meera Rani v. Government of Tamil Nadu, said that the order to imprison Ali Mohammad Sagar is illegal, as the authority detaining him has ignored the fact that he was already in custody is.
Apart from this, there is no basis for the reason being given for capturing him. It is expected that Naeem Akhtar and Hilal Akbar will also be released: Omar
Meanwhile, National Conference vice-president Omar Abdullah expressed happiness over the decision to remove the PSA on Ali Mohammad Sagar, saying that Naeem Akhtar and Hilal Akbar Lone have not yet challenged the PSA in court.
It is expected that the administration will release them as well.
Those who have been under house arrest are also expected to be released soon. Omar also referred to a petition filed in the Supreme Court for the release of former Chief Minister Mehbooba Mufti.
He said that I hope that in relation to Mehbooba’s lawyer Ali Mohammad Sagar will be excited by the order of the High Court. He will appear in the court of Mehbooba’s case with more enthusiasm.
