Supereme Court to Hear Petition Challenging 35A Today- Reports

The Supreme Court will according to ANI will hear a petition seeking the scrapping of Article 35 A in the state of Jammu Kashmir, three weeks after the court was adjourned on August 06.

The Jammu Kashmir government had moved an application and sought to defer the hearing of the case, citing upcoming panchayat and urban local body elections.

Article 35A disallows people from residing in Jammu Kashmir, buying or owning immovable property in the state, settle permanently, or get state government jobs.

A non-governmental organisation, We the Citizens, filed a petitioned in the Apex Court in 2014 to abolish the law on the grounds that it was “unconstitutional”.

There are apprehensions, amongst sections of Kashmiris, that if the law is repealed or diluted, outsiders would settle in Jammu and Kashmir.

Another report suggests that a Fresh petition has been filed by Ashwani Updhyay challenging the Article 35A which will be heard today by the apex court of India.

The Hurriyat leadership had issued a Hartal for August 26, 27 and later postponed it after news agencies said it was likely that the Supreme court will defer the hearing to August 31. (The Kashmiriyat)
