High Court Grants Bail to Pinjra Tod’s Natasha, Devangana Kalita and Asif Iqbal Tanha

A bench of Justices Sidharth Mridul and Anup Jairam Bhambhani of the Delhi High Court today granted bail to students activist Asif Iqbal Tanha and Pinjra Tod activists Natasha Narwal and Devangana Kalita in the Delhi riots conspiracy case under UAPA.

Bail is conditioned on a personal bond of Rs 50,000 and the presence of two local sureties. The three must relinquish their passports and refrain from engaging in actions that will jeopardize the case in order to be released on bond.

Since May 2020, Narwal and Kalita, both PhD researchers at Jawaharlal Nehru University and members of the Pinjra Tod Collective, have been detained. Narwal was recently granted interim bail in order to attend the funeral of her now-deceased father.

The Delhi High Court had previously reserved its decision in Jamia Millia Islamia student Asif Iqbal Tanha’s petition against his bail being denied in connection with a criminal case.

Tanha allegedly obtained a mobile SIM card with forged paperwork and used it to arrange chakka jaams, riots and the creation of a WhatsApp group, according to police. The SIM was also allegedly given to another Jamia student and co-accused Safoora Zargar in order to organize more protests

Tanha has filed a request dated 26th October 2020 excusing his bail supplication who was captured under the severe UAPA. Extra Sessions Judge Amitabh Rawat dismissed the bail application after by all appearances seeing that the body of evidence was viable against Tanha and that he purportedly assumed a functioning part in the whole connivance. Before the Delhi High Court, Advocate Siddharth Agarwal represented the accused, Tanha, while Aman Lekhi represented the State authorities.

He is also said to be a close associate of Safoora Zargar, Umar Khalid, Sharjeel Imam, others and a “major member of anti-CAA rallies and ensuing rioting in the national Capital,” according to reports.

Tanha, along with others, allegedly plotted to “overthrow the government” by erecting a chakka jam (road jam) in Muslim-dominated areas.

Tanha, Narwal, and Kalita were among the 15 people listed in the FIR 59/2020, which was filed by Delhi Police in the Delhi riots plot case.
