NC Leader files defamation case against Kashmiri Pandit ‘Activist’ for ‘lying’ about NC leaders over migration issue

The Court of Chief Judicial Magistrate has summoned Sandeep Mawa after National Conference leader and former Minister Nasir Aslam Wani filed a defamation case through his Counsel.

The complainant in his petition has contended that the accused Sandeep Mawa is a self-styled social worker claiming to be the Chairman of an organization working under the name and style of the Jammu and Kashmir Reconciliation Front. The accused according to the complainant in an interview with the media made derogatory remarks about him. The interview as per the petition has widely been viewed by people, thus tarnishing the image and reputation of the complainant.

The complainant has submitted that the remarks made by the accused are not only vile, reckless, unsubstantiated but are also absolutely uncouth and per se defamatory and disparaging and have incorrigibly tarnished and harmed the reputation of goodwill and public image of the complainant herein.

The Counsel for the complainant as per news agency Kashmir News Trust has stated that the statements being made by the accused are totally false and baseless, disparaging publicly the reputation, good name and fame of the complainant enjoyed as a political figure of high probity, in society in general and amongst friends and colleagues in particular.

“It is averred that the disparaging and defamatory statements publicly made by the accused against the complainant are defamatory per se with all the trappings and attributes constituting and frowned upon by law as a Criminal Offence of defamation as defined under Section 499 made punishable under Section 500 of Indian Penal Code.”

Taking cognizance of the petition, the court stated that it is satisfied that cognizance in respect of the offence under section 500 IPC has to be taken against the accused. Therefore, cognizance in the said offence is taken, as such summon is issued to the accused of his appearance before the court on the next date of hearing listed on 6 April next month.

The court stated that the summons be sent to SHO Police Station Karan Nagar, Srinagar for execution upon the accused along with a copy of the complaint.

Pertinently, Sandeep Mawa in a series of interactions with the media had levelled serious allegations against the complainant, Omar Abdullah, Farooq Abdullah and Mehbooba Mufti. (KNT)
