“Please Help us Fight power”- Srinagar Family accuse Businessman of land grab and harassment

On Saturday, a video clip took the internet by storm. The video was widely circulated on social networking sites which was uploaded by a resident of Hyderpora, Srinagar namely Aalia Wahid.

In this distress video, she is heard saying, “ My name is Aalia Wahid, I am the resident of Hyderpora, this is the common road shared by us and other residents of the area, we have a stay order on the road, we even have a case registered in the court for more than a half year against the person who has been harassing us for past one year, the person namely Mukhtar Ahmad Shah is illegally installing a gate on the road, and have brought both male and female police officials with him. The female police have harassed my mother, grandmother, and me, please help us, there are more than 60 persons outside our house who manhandled us.”

Mukhtar Ahmad Shah is the owner of Royal Concept which is at Lal Chowk, Srinagar, and a hotelier and a resident of Khanyar presently and is constructing a new house at Hyderpora.

The Kashmiriyat got in touch with the woman on the video clip and spoke to her sister Jasiya Wahid who said, “The incident took place around 11:00 am, when her mother, Aarifa Wahid, heard some noise coming from outside, she had ignored at first but when the noise came continuously, her mother had gone outside to see what is happening. “my mother saw so many police officials outside her house, who told her to go inside, we are installing a gate here and pushed her”, she added.

The Kashmiriyat also accessed a court via order with CNR number JKSG030017172021 dated 27 January 2021 in the case titled Aarifa Wife of Late Abdul Wahid R/o Hyderpora Srinagar. (Applicant) Versus Mukhtar Ahmad Shah Son of Mohammed Maqbool Shah Hyderpora, Srinagar stating that the applicant shares a common pathway with the Mukhtar Ahmed Shah since long back, but recently the Mukhtar has started some illegal construction and started to dump building, material along the same pathway. The applicant has got an electricity supply from the same side which the non-applicant is threatening to disrupt and also trying to block the drainage pipe of the applicant so as to make the life of the widow/applicant miserable in these tough times of epidemic.

The Court of the Munsif also directed the officials to direct the Police station Humhama to provide protection to the life and property of the applicant and ensure that the applicant is allowed to use the common pathway and her electric and drainage supply be not interfered with. The non-applicants may be also directed to stop threatening and intimidating the applicant and the same shall be in the larger interests of justice.

Jasiya said that after the noise intensified the family members came outside but were beaten. “My sister’s clothes were stripped and her phone was snatched by a lady constable, somehow she had managed to capture the incident,” she told. He (Mukhtar) was carrying a tehsil order. He was installing a gate on the road,  when we showed our documents to them they refused to check them out, He was having police protection with him, she added.

“When there was a fraud, that is why he was having police with him”, she said. She said, “He is an influential person and thinks that he can overpower us but we will not let him do so”. She said that we have a case registered in the court for more than a half year against him. The decree has come in our favor, she told. The case was pleaded by their mother in court.

Jasiya told The Kashmiriyat that “ Mukhtar had tried to disconnect their electricity by removing the electricity pole outside their gate last year”. “Our father died in 2019, we are three sisters, we don’t have any male member at our house, taking advantage of that, he has tried to exploit us”, she added. “We have been living here for the past 30 years and he is yet to come here to reside, still he is doing such things by his power”, she said.

Accusing the female Policemen of assaulting the female members of her family, Jasiya said, “My mother, sister, grandmother and were beaten and harassed by the police and have got some injuries too”, she said.

It is not impacting us only, our little children are also in a state of trauma by the continuous harassment, she added.

Meanwhile, The Kashmiriyat spoke to a Police officer who denied the allegations about using force against the family said, “There is a long pending dispute pending between the two parties on a pathway and is sub judice in different forums. An FIR No.458/2020 under sections 379,451 and 506 IPC stands already registered at Police Station Budgam and the investigation into the matter is going on in the matter.”

He said that the Police were on the spot to assist in the implementation of an order issued by Tehsildar South City Srinagar. “No use of force was made or any misbehavior was done by Police.” The Police party was not there to support any person but to assist the revenue authorities in the implementation of the aforementioned order.

The SSP Budgam has called the party to Budgam SSP Office today at 10 30 am to listen to any issue/ grievances, the official said.
