The Jammu Kashmir administration has served eviction notices to two former Legislators of the Jammu Kashmir National Conference and asked them to vacate the Government property at Housing Colony in Anantnag’s Khanabal area.
As per an eviction notice issued to the former people’s representative, of which a copy was accessed by The Kashmiriyat, the Tehsildar has asked Abdul Majid Bhat (Larmi) to vacate the scheduled public premises on or before February 28.
Speaking to The Kashmiriyat, Abdul Majeed Bhat (Larmi) confirmed that the eviction notice was served to two MLAs of National Conference including Altaf Ahmed Kaloo, former MLA Pahalgam and Abdul Majeed, former MLA Home Shali Bugh constituency.
He said that earlier, his security was downgraded and now he’s being sent the eviction notices, one after the other.
“We are being targetted for our political beliefs. The BJP is upgrading the security of the smallest of its workers, while the security of non-BJP politicians is being downgraded every now and then. This is a clear instance of political vendetta,” Abdul Majeed Larmi said.
Pertinently, Larmi was served notice of evicton on 05 December, 2022 after which he approached the local court which put a stay at the administration’s order seeking the removal of several NC and PDP leaders from housing colony in Khanabal within seven days.
“Whereas, the show cause notice vide No. 133-38/MM/Qtr dated 05.12.2022 read with the corrigendum No 141-45/MM/Qtr dated 05.12.2022 was served to you and every person occupying the said public premises wherein you were called upon to show cause within the statutory period of 07 days, as to why an order of eviction should not be passed against you,” a copy of the order pasted outside the gate of Abdul Majeed Larmi in Housing Colony Khanabal reads.
The notice further says that the said notice was challenged by you before Hon’ble High Court and the Hon’ble Court of J&K at Srinagar on 07.02.2023 was pleased to dismiss the writ petition bearing No. WP(C) No. 2751/2022. Afresh eviction notice under Sub Section (1) of Section of Jammu & Kashmir Public (Eviction of un-authorized Occupants) Act, 1988, read with amended Act, 2016 vide No.TEO/MM/Qtr/285-86 Dated. 13-02-2023 was served to you. Whereas, in response to the above notice, your reply was received, perused, considered and rejected vide Order under endorsement No. 309/TEO/MM/Qtr dated; 23.02.2023, being bereft of any merit.
“The said public premises is urgently required for the smooth functioning of the Government/District Administration.”
Now Therefore, in exercise of powers conferred under Section 5, Sub Section (1) of Jammu and Kashmir, Public Premises (Eviction of unauthorized occupants) Act, 1988, I, hereby order that Mr. Abdul Majeed Bhat and all persons who may be in occupation of said public premises or any part thereof, to vacate the scheduled public premises on or before 28.02.2023, and in the event of refusal or failure to comply with this order within the specific period, provision of sub-section (2) of Jammu and Kashmir, Public Premises (Eviction Of Unauthorized Occupants) Act, 1988 shall be invoked against you and every such person occupying the scheduled public premises, read the official notice.
